This website is operated by TopTool EU. Throughout the site, the terms “we”, “us” and “our” refer to TopTool EU / TopToolOnline.

TopTool EU provides this website, including all information, tools, products and services available from this site, to you, the customer, subject to your acceptance of these Terms of Service and any policies referenced here, including our Return & Refund Policy, Shipping Policy, Privacy Policy and Legal Notice.

By visiting our website, placing an order or using our services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not use our website or services.

Nothing in these Terms limits or excludes any mandatory rights you may have as a consumer under applicable consumer protection laws, including any rights available to consumers in the European Union.

You may browse our website without creating an account. To place an order or access certain customer services, you may be required to provide information such as your name, email address, billing address, shipping address and payment information.

You confirm that the information you provide is accurate, complete and up to date. You are responsible for keeping your customer account access secure.

SECTION 2 - OUR PRODUCTS AND PRODUCT INFORMATION

We sell professional automotive diagnostic tools, service tools, accessories, software update services and related products from brands such as TOPDON, Launch, Autel and other professional tool manufacturers.

We make reasonable efforts to display product information, specifications, images, compatibility details, update periods and included accessories accurately. However, product images, packaging, software interfaces and accessories may vary slightly depending on batch, region, manufacturer updates or screen settings.

Vehicle compatibility and available functions may vary depending on vehicle make, model, year, engine type, control module, region, software version and manufacturer coverage. Some advanced functions, such as ECU coding, online programming, security gateway access, key programming, ADAS functions or special service functions, may not be available for every vehicle.

If you require a specific function or vehicle coverage, we recommend contacting us before purchase with your vehicle make, model, year and VIN where possible. Our compatibility advice is based on the information available from the manufacturer or supplier at the time of checking and does not override the actual software coverage of the device.

Any commercial warranty, manufacturer warranty or technical support offered by us is in addition to, and does not limit, mandatory statutory rights available to consumers under applicable law.

SECTION 3 - ORDERS AND ORDER ACCEPTANCE

When you place an order on our website, you are making an offer to purchase the selected products. Your order is accepted when we confirm acceptance and process the order.

We reserve the right to reject, cancel or limit an order where reasonably necessary, including but not limited to cases involving incorrect pricing, product unavailability, suspected fraud, payment failure, delivery restrictions, supplier restrictions, sanctions, export limitations or incorrect customer information.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.

Products may be purchased for personal or professional use. Resale, unauthorized distribution, export control violations or use in restricted regions are not permitted without our prior written consent.

SECTION 4 - PRICES, TAXES AND BILLING

Prices displayed on our EU store are shown in EUR unless otherwise stated.

Unless otherwise clearly stated at checkout, prices shown on our EU store include applicable taxes for the customer’s market and include or display the applicable shipping costs before checkout completion.

For orders shipped from within the EU to EU countries, customers should not be charged additional customs duties or import VAT upon delivery.

For orders shipped to countries outside the EU, or in special delivery cases, customs duties, import taxes, handling fees or local charges may apply depending on the destination country. These charges are the responsibility of the customer unless otherwise stated at checkout.

We may change prices, promotions and product availability at any time without prior notice. The price charged for an order will be the price shown at the time the order is placed and confirmed.

If you provide a VAT number, tax ID or company information, we may include it on your invoice or order record where possible. However, unless expressly stated, we do not guarantee that an invoice will be an EU VAT-deductible invoice or contain a separate EU VAT number.

SECTION 5 - PAYMENT

You agree to provide accurate and complete payment information.

By submitting payment information, you confirm that you are authorized to use the selected payment method and that sufficient funds or credit are available to complete the transaction.

We may use third-party payment providers to process payments securely. We do not store full payment card details on our own servers.

If a payment is declined, reversed, flagged as suspicious or subject to a payment dispute, we may delay, cancel or suspend the order until the issue is resolved.

SECTION 6 - SHIPPING AND DELIVERY

Delivery times shown on our website are estimates and may vary depending on destination, warehouse location, carrier performance, customs processing, holidays, weather, force majeure events or other factors outside our reasonable control.

We will make reasonable efforts to ship orders within the estimated timeframe. However, delivery estimates are not guaranteed unless expressly stated.

For consumer orders, the risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, physically receives the goods.

Please inspect the package after delivery. If the product is damaged, incorrect or missing items, contact us as soon as possible at support@toptoolonline.com with photos, videos or a description of the issue.

SECTION 7 - RETURNS, CANCELLATIONS AND EU RIGHT OF WITHDRAWAL

Returns, refunds and order cancellations are governed by our Return & Refund Policy.

EU consumers have a legal right to withdraw from a purchase contract within 14 days without giving any reason, subject to applicable legal conditions and exceptions.

In addition to the legal withdrawal right, TopTool EU offers a 30-day return period from the date your item is delivered, unless otherwise stated on the product page.

For unfulfilled orders, customers may request cancellation before the item is fulfilled. If an order has already been processed, handed over to the warehouse or shipped, cancellation may no longer be possible and the order may need to be returned after delivery.

For customer-initiated returns, the customer is generally responsible for return shipping costs unless the product is incorrect, damaged, faulty or not working upon arrival.

Returned products should be sent back in their original packaging where possible, including all accessories, cables, adapters, manuals, free gifts and included items.

You are responsible for any reduction in the value of the goods caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

SECTION 8 - SOFTWARE, DIGITAL SERVICES AND ACTIVATION PRODUCTS

Some products or services may include software updates, online services, activation codes, security gateway access, online tokens, digital licenses or manufacturer cloud services.

Software update periods, online access, cloud functions and activation services are subject to the rules, coverage and availability of the relevant manufacturer or service provider.

After a free update period expires, the device may continue to use installed software where supported, but functions requiring server access, online authorization, software updates, security gateway access or cloud services may be limited or require a paid renewal.

Digital activation codes, software update renewals, online service tokens, customized services or special-order items may not be eligible for return once delivered, activated, used or redeemed, where permitted by applicable law and where this is clearly stated before purchase.

All content on this website, including but not limited to text, images, graphics, product descriptions, layout, logos, icons, videos, software interfaces, design elements and other materials, is owned by TopTool EU, our suppliers, licensors or other rights holders.

You may use our website for lawful personal or business purchasing purposes only.

You may not copy, reproduce, distribute, modify, publish, scrape, download, store, transmit, resell or exploit any part of our website or content without our prior written permission, except where permitted by law.

TopTool, TopToolOnline and related names, logos, product page content and website materials may not be used without authorization.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

Any purchase made through our store is made directly with TopTool EU, not with Shopify. Shopify is not responsible for the products sold by us, the fulfillment of your order, product support, warranty service, returns or refunds.

Where a manufacturer warranty or commercial warranty is provided, it is offered in addition to your mandatory statutory rights and does not replace them.
